Virginia’s Department of Professional and Occupational Regulation oversees Virginia’s Common Interest Community Board (CICB), which regulates common interest community managers, as well as certain employees of licensed management firms. The CICB oversees state-run community association task forces and initiatives, holding quarterly in-person meetings to discuss the current needs of the Board and common interest community industry in Virginia.
SB 740 Update, Common interest communities; standards for structural integrity and reserves for capital components.
CAI’s Government and Public Affairs staff attends each quarter’s meeting and provides public comment on behalf of CAI when appropriate. This June’s CICB meeting focused on the newly passed SB 740 in the Virginia General Assembly. SB 740 requires the Department of Professional and Occupation Regulation (DPOR) to establish a work group to study the adequacy of current laws addressing standards for structural integrity and for maintaining reserves to repair, replace, or restore capital components in common interest communities, among other general items related to common interest communities. A report is due to the Virginia Senate and House Committees on General Laws on April 1st, 2023. This legislation was introduced following the tragic partial collapse of Champlain Towers South in Surfside, Fla., last year.
The CICB has created a group of 20-25 industry expert professionals, who will meet approximately 6 times between July 2022 and April 1, 2023, to develop this report. The CICB will also be hiring a staff person to help with this effort.
The first meeting will be held on Friday, August 5th and Dawn Bauman, CAE, SVP of CAI Government and Public Affairs at CAI, will provide the work group an overview of CAI’s Condominium Safety Public Policy Report and accompanying efforts. Phoebe Neseth, Esq., the director of CAI’s Government and Public Affairs team, was invited by the CICB to serve as a volunteer community leader representative on the Structural Integrity and Reserves Work Group as established in Senate Bill 740 and will participate in this effort over the next year. CAI will continue to update its Virginia membership on these efforts over the next year. The following CAI members are also participating in the Virginia Structural Integrity and Reserves Workgroup:
