All 50 states, as well as the District of Columbia, convened for their legislative session in 2025. CAI’s state legislative action committees worked tirelessly to advocate on behalf of the more than 77.1 million Americans living and working in community associations, according to the Foundation for Community Association Research. By monitoring state legislation, educating lawmakers, and advocating on policy positions, LACs protect the interests of the community association industry.
Over 40 states have adjourned their legislative sessions for 2025. CAI tracked more than 2,000 bills at the state level impacting community associations, with more than 500 directly impacting associations. Here are some key highlights:
- Arizona. Construction defect regulations, declaration amendments, declarant transition
- Arkansas. Clarifying updates to the Horizontal Property Act, short-term rentals
- California. Manager licensing
- Colorado. Foreclosure procedures
- Connecticut. Association meeting procedures, daycare regulations, renting in CIOS, solar energy regulations, reserve studies, corporate investor regulations
- Florida. Ombudsman programs and swimming pool regulations
- Georgia. Disclosure processes, HOA board regulations, liens, and assessments regulations, ombudsman, solar energy
- Hawaii. Construction defect regulations, fining authority, replacement reserve fund balance, removal of discriminatory restrictive covenants
- Idaho. Chicken regulations
- Illinois. Reserve studies, little neighborhood libraries, Ombudsman office sunset extension.
- Indiana. Manager licensing, beekeeping regulations, HOA regulation procedural updates, lemonade stand regulations
- Kansas. Home-based businesses
- Kentucky. Political signs, middle housing regulations
- Maine. Electric vehicle charging stations, Maine Common Interest Ownership Act
- Maryland. Reserve study and funding regulations, solar regulations, insurance deductibles, HOA task force, manager licensing
- Massachusetts. Board transparency, commission to study condos, condo elections, HOA board elections, solar energy regulations, display of the U.S. flag within condos
- Minnesota. Management company contracts, ombudsman office
- Missouri. Homeowner bills of rights
- Montana. Accessory dwelling units, construction defect regulations, HOA budget and financial report publishing, HOA law modifications
- Nebraska. Political signs and solar regulations
- Nevada. Anti-harassment and bullying provisions, condominium safety, electric vehicle charging stations, insurance, religious displays
- New Hampshire. Updating condo board instruments and utilities in condos
- New Jersey. Reserve studies and building inspection updates, manager licensing, board member education
- New York. Access to units for repairs, condo/coop tax assessments, lifting assessment caps, reserve studies
- North Carolina. Mediation and dispute resolution, data collection for industry complaints, license plate readers, procedures for managing agent contracts, fines, liens, and inspections of association records
- North Dakota. Disclosure documents
- Ohio. Political signs
- Oklahoma. Disclosure document regulations and fee caps
- Oregon. Beekeeping, construction defects, wildfire insurance
- Pennsylvania. Solar and clothesline regulations
- Rhode Island. Mortgagee notice, deductible changes, remote meetings
- South Carolina. Foreclosure regulations; amateur radio
- Tennessee. Home-based childcare regulations
- Texas: Accessory dwelling units, attorneys’ fees and architectural review and fee caps, board vacancy, canvassing, chicken regulations, clotheslines regulations, drought fines, flags and free speech/assembly regulations, insurance, removal of discriminatory covenants, solar, storm insurance, transfer of real estate
- Utah. Alternative dispute resolution, HOA transparency and developer transition, basketball hoop regulations, design review process, vegetable garden regulations, holiday decor regulations, for sale signage regulations, manager licensing, sex offenders in community associations
- Vermont. HOA information center
- Virginia. Resale disclosures; HAM radio regulations, gaming and bingo
- Washington. Amending and updating the Washington Common Interest Ownership Act
- West Virginia. Home-based businesses, removal of discriminatory restrictive covenants, chickens and gardening
- Wisconsin. Accessory dwelling units, chicken and fowl regulations
